The Wildfire Recovery Compensation Program provides eligible individuals and businesses prompt and certain compensation for direct impacts from the Eaton Fire. Find out what exactly is included in a compensation offer and view sample offers.

MULTIPLE COMPONENTS OF COMPENSATION

There are four types of compensation available through the program:

  • Economic Loss
  • Non-Economic Loss
  • Direct Claim Premium
  • Attorneys’ Fees

Economic Loss

Economic loss refers to the measurable financial harm experienced by a claimant because of property damage, business interruption, physical injury or losing someone due to the Eaton Fire. If you’re eligible, you can get compensation for things like damaged or destroyed structures, personal property and landscaping. You can also get compensation for not being able to use your property, which is called “loss of use.” Eligible renters can get compensation for personal property and extra moving costs. Businesses can claim lost income. For physical injuries, the program pays a flat amount. Insurance coverage may reduce what you receive.

Non-Economic Loss
This is compensation for personal impacts from the Eaton Fire that are not financial in nature. Non-economic compensation is paid in uniform amounts, based on the type of economic damages sustained. There are separate amounts designated for adults and children within the eligibility area.

Direct Claim Premium
In addition to economic and non-economic compensation, SCE will add a Direct Claim Premium to all offers. This premium is only available through the Wildfire Recovery Compensation Program and will not be available in litigation.

The Direct Claim Premium is a uniform amount applied per claimant group per category, as follows:

  • Death claims: $5,000,000 per decedent
  • Physical injury claims: $20,000 per injured individual
  • Claims for destroyed structures:
    • Residential owner-occupant of a destroyed primary structure: $200,000
    • Residential owner-occupant of a destroyed secondary structure: $100,000
    • Residential owner-landlord of a destroyed primary structure: $150,000
    • Residential owner-landlord of a destroyed secondary structure: $25,000
    • Residential tenant occupying a destroyed structure: $50,000 per adult
    • Commercial owner of a destroyed structure(s): $25,000
    • Commercial tenant of a destroyed structure: $25,000
  • Claims for other damaged structures (classified as Major Damage, Minor Damage, Affected by DINS and/or with non-burn damage from smoke, soot or ash infiltration):
    • Residential owner-occupant: $10,000
    • Residential owner-landlord: $5,000
    • Residential tenant: $5,000 per adult
    • Commercial owner: $5,000
    • Commercial tenant: $5,000

Attorneys’ Fees
Claimants represented by counsel at the time they submit a claim will receive an offer for additional compensation equal to 20% of their net damages (defined as economic damages — minus any applicable insurance offsets, plus any non-economic damages) to help address legal costs.

Participation in the program does not constitute an admission of liability or wrongdoing, and the company expressly denies responsibility for the underlying events. All rights, defenses and legal positions in pending and future litigation are fully reserved. This program is offered solely as a compromise and is intended to be protected under applicable laws, including California Evidence Code sections 1152 and 1154.
